The candidate for the presidency of the Government, Alberto Nuñez Feijóo, has proposed approving the renewal of the General Council of the Judiciary " at the same time that a law to reform the election model is registered in the Chamber, in which the judges elect the judges and jurists of recognized prestige are elected in the Cortes Generales.
"I defend that there are no politicians on your Council lists," said Feijóo during his investiture speech, in which he asked that "it be guaranteed that Justice is at the service of the Spanish people and not of politicians." In this sense, he has assured that his model defends the separation of powers, the independence of Justice.
The European Commission has repeatedly urged Whatsapp Database Spain to urgently renew the governing body of the judges, although it has called to do so first with the current rules and, subsequently, to change the rule to return to a system in which that the 12 members of judicial origin be chosen by the judges in a way that would have to be determined.
"I do not support having changed the law to limit powers" so that members of the CGPJ cannot make appointments . "I do not accept that ministers and senior officials are appointed as members of the Constitutional Court, (...) the presidency of the Supreme Court cannot be negotiated between parties, it is up to the Council," he stated, within the framework of the first of the six proposed pacts , before demanding the "total closure of the revolving doors between politics and the judiciary." The Prosecutor's Office cannot be anyone's private preserve , insisted the candidate, who proposes adopting the necessary changes to protect the impartiality and independence of the State Attorney General. "A person cannot be a minister in the morning and a prosecutor in the afternoon."
In the speech, the leader of the PP said that “he does not agree that judges are called fascists in toga for applying a poorly made law” and even less that the Government of the nation does so. He has thus referred to the criticism received by the judges for the application of the Law known as the Only if it is yes.
Nuñez Feijóo has flatly rejected the Amnesty Law that would be negotiated with the pro-independence parties with the aim of enabling the investiture of Pedro Sánchez after the presumed failure after the votes that follow this session. Regarding this norm, which the Government has avoided mentioning directly in recent weeks, it has stated that "it is not going to defend it because it has principles, limits and a word (...) I promised to keep the Constitution, which is the foundation of our progress. This text cannot be circumvented with decisions that eliminate equality. It is neither legally nor ethically acceptable (amnesty). Outside the Constitution there is no democracy” he said. He has described it as a “ legal and moral aberration that breaks the principle of equality . ” According to Feijóo, "depriving judicial resolutions of any effect breaks the principle of separation of powers ."
